Nintendo Files Lawsuit Against Accessory Manufacturer Over Switch 2 Mockup – Android Authority

Nintendo has initiated legal action against Genki, an accessory manufacturer, for producing an unauthorized mockup of the Switch 2 console. The lawsuit, filed in the US District Court for the Central District of California, claims infringement of Nintendo’s trademark, as well as accusations of unfair competition and false advertising. Nintendo contends that Genki sought to exploit the high demand for the new console by suggesting that its products were officially sanctioned or linked to Nintendo.

The controversy arose when Genki unveiled a mockup of the Switch 2 at CES 2025, claiming it closely resembled the actual console. Nintendo’s lawyers quickly intervened, escalating the situation through formal legal proceedings. The lawsuit outlines an alleged pattern of misleading behavior from Genki, which purportedly claimed unauthorized access to the unreleased Switch 2 and advertised compatible accessories despite later stating it had no such device.

Nintendo argues that Genki’s representations misled consumers about the compatibility of its products and questioned the legality of how Genki obtained information about the console. Furthermore, Nintendo asserts that Genki utilized its trademarks in a manner intended to confuse the public, exemplified by a promotional video featuring the Switch 2 and its dock. Acknowledging the potential for significant misunderstanding, Nintendo felt compelled to issue a statement clarifying Genki’s mockup status as unofficial.

In the lawsuit, Nintendo seeks an injunction against Genki’s use of the term “Nintendo Switch” in its marketing efforts and demands the destruction of any related promotional materials. Nintendo also requests reimbursement for damages, legal fees, and any profits Genki has made from the sales of its controversial products. In response to the lawsuit, Genki confirmed its receipt of the legal notice on social media, stating that the company is approaching the matter with seriousness and is engaged with legal counsel, while also continuing to prepare for product showcases at upcoming events.
